Welcome to HTMA Test Canada. By accessing our website or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Services Description

HTMA Test Canada provides Hair Tissue Mineral Analysis (HTMA) testing services. Our services include:

• Facilitating hair sample collection — instructions and submission form provided by email
• Processing hair samples through our partner CLIA-certified laboratories
• Delivering test results and reports
• Providing optional interpretation and consultation services

2. Important Health Disclaimer

HTMA Test Canada provides informational testing services only. We are not a medical provider and our services do not constitute medical advice, diagnosis, or treatment.

Specifically:

• Our test results and reports are for informational purposes only
• Results should not be used to diagnose or treat any medical condition
• You should always consult with a qualified healthcare provider before making any health-related decisions
• Our dietary and supplement suggestions are general information, not personalized medical advice
• Do not discontinue any medication or treatment based on our test results without consulting your healthcare provider

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be a resident of Canada
• Have the legal capacity to enter into contracts
• Provide accurate and complete information

Parents or legal guardians may order tests on behalf of minors under their care.

4. Orders and Payment

Pricing: All prices are displayed in Canadian Dollars (CAD) and include applicable taxes. Prices are subject to change without notice, but changes will not affect orders already placed.

Payment: Payment is required at the time of order. We accept major credit cards and other payment methods as displayed at checkout. All payments are processed securely through our third-party payment processor.

Order Confirmation: After placing an order, you will receive an email confirmation. This confirmation does not guarantee fulfillment; orders are subject to product availability and validation.

5. Sample Collection and Submission

You are responsible for:

• Following the sample collection instructions provided by email
• Providing a sufficient quantity of hair for testing (approximately 1 tablespoon)
• Mailing your sample to the lab within 60 days of ordering
• Ensuring the sample is from the individual who will receive the results

Invalid Samples: If your sample is insufficient or invalid for testing, we will contact you to discuss next steps. The customer is responsible for following collection instructions — invalid samples due to collection errors are not eligible for a free retest and a new order would be required. Cases involving lab-side errors will be reviewed individually.

6. Test Results and Reports

Delivery: Test results are typically delivered within a few weeks of receiving your sample at our laboratory. Results are sent via email in PDF format.

Accuracy: While our laboratory partner maintains high standards of accuracy, we cannot guarantee that results are error-free. Test results reflect the mineral content of the hair sample at the time of collection.

Interpretation: Comprehensive and Premium packages include interpretation. Interpretations are based on established reference ranges and mineral patterns but should not be considered medical advice.

7. Consultation Services (Premium Package)

Premium package consultations are:

• Educational and informational in nature
• Not a substitute for professional medical advice
• Subject to scheduling availability
• Valid for 90 days from results delivery

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of HTMA Test Canada or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law:

• HTMA Test Canada shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
• Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim
• We are not liable for any health outcomes, decisions, or actions you take based on our test results or reports

10. Indemnification

You agree to indemnify and hold harmless HTMA Test Canada, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of British Columbia.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
